Solving difficulties in labeling of goods

On April 24, 2019 the Directorate for Standards, Metrology and Quality in coordination with VCCI and a number of associations (AMCHAM, EUROCHAM, VASEP …) organized a workshop to comment on the Draft Circular guiding Decree No. 43/2017/ND-CP on goods labels.

The workshop is organized to collect opinions from the ministries, agencies, associations, businesses and related parties nationwide.

Mr. Nguyen Hoang Linh – Deputy Director General of STAMEQ stated the opening ceremony.

Decree No. 43/2017/ND-CP on goods labels regulating the way of recording and state management of labels for goods circulated in Vietnam, imported goods, replacing Decree No. 89/2006 / ND -CP on August 30, 2006 by the Government on goods labels.

Basically, Decree No. 43/2017/ND-CP has overcome many difficulties and problems of Decree No. 89/2006/ ND-CP, removing many difficulties for businesses, creating a favorable business environment and improving national competitiveness.

However, in the process of implementing Decree No. 43/2017/ND-CP, there are still points that need detailed guidance and concretization to facilitate the application process from enterprises and government agencies. Continuing to implement Decree No. 43/2017/ND-CP, the Directorate for Standards, Metrology and Quality (STAMEQ) assigned by the Ministry of Science and Technology presided to formulate a Circular guiding Decree No. 43/2017/ND-CP for detailed guidance for businesses.

Speaking at the workshop, Mr. Nguyen Hoang Linh – Deputy Director General of STAMEQ affirmed that the development of the Circular guiding Decree No. 43/2017/ND-CP to ensure continued guidance on creating favorable conditions for enterprises to clearly and transparently record goods, create a favorable business environment, improve the effectiveness and efficiency of state management of goods labels as well as strengthening consumer protection in choosing products and goods with transparent and clear labels and complying with legal regulations on goods labels.

“This workshop is one of the consultations with stakeholders from enterprises, management agencies and consumers to help build and complete the Draft Circular, ensuring Circular issued in a feasible manner, in accordance with the practical conditions of Vietnam, at the same time solving difficulties and problems of the business community in the labeling of products and goods in the past time”, Mr. Nguyen Hoang Linh said.

 

AMCHAM Vietnam’s representative also said that labeling is a very important topic, because the labeling regulations are considered as “keepers” of products. And labels on goods help consumers understand important information about the products that they buy. In addition, clarifying the regulations, helping to improve the business information of customers through labels.

The point of directing the drafting of this Circular is to determine the provisions of Decree No. 43/2017/ND-CP. It is unclear which causes difficulties in the process of implementing and developing the content in the Circular. Besides, solving problems and difficulties for enterprises, state management agencies and protecting national interests and consumer interests. Considering the guidelines in accordance with the provisions of Vietnamese law and International agreements and commitments signed by Vietnam. Following the process of formulating legal documents, collecting opinions of affected subjects before issuing them.

 

Director General of the Department of Goods Quality Control Tran Quoc Tuan runs a workshop to receive opinions of associations.

In the workshop, the opinions of the ministries, agencies, associations and enterprises are emphasized in the chapters in the Circular guiding Decree No. 43/2017/ND-CP dated 14 April, 2017 of the Government on goods labels. Specifically, about chapter 1 of the general provisions on the position of goods, in case the goods have both direct packaging and outer packaging received many opinions that cause waste and unnecessary.

Or about the instruction for labeling of goods in case the label lacks the contents of the addition and correction of the contents of the goods label, the consent of the competent state management agencies shall be obtained. Along with that is the component specified in Clause 1, Article 16 of Decree No. 43/2017/ND-CP whose contents contain this component or this component exists in the input materials with good which is necessary to modify the structure of words for businesses to understand. All comments at the workshop will be synthesized, reviewed and received to finalize the Draft Circular before officially promulgating./.
